Comparative Lawyers鈥 Ethics

During this course, we will study the American Bar Association鈥檚 Rules of Professional Conduct and compare it, and the ethical structure in the United States, to the structural legal systems and rules governing lawyers鈥 conduct in the Netherlands, Curaca

o and France. Some topics reviewed in class will overlap with the Multi-State Professional Responsibility Examination, an exam required for admission to the bar in many U.S. states.

Key rules to be discussed include confidentiality, attorney-client privilege, and conflicts of interest. In addition, the structure of the legal systems in Curacao, the Netherlands, and France (countries governed by civil law and partners in the European Union) will be explored. We will also have a broader discussion on how the comparative rules shape the 鈥渧alues鈥 of attorneys as it relates to client representation and a lawyer鈥檚 role in society.

Taught by Prof. C. Benjie Louis (Hofstra).

From Refugee to Resettlement: An Introduction to Refugee Law and Overseas Refugee Processing for Vulnerable Populations

According to the UN Refugee Agency (UNHCR), there are 43.4 million refugees worldwide -- a 7 percent increase over the prior year. While ongoing conflicts are producing large-scale displacements of populations crossing international borders, less than 1 percent of all refugees are eventually resettled. Refugee resettlement is one of the three durable solutions for refugees who have fled their countries and are unable to return home for fear of persecution.

So how does a refugee get resettled? Which laws and policies determine eligibility for refugee status? What is the process? Who are the players? This course offers an introduction to refugee law and overseas refugee processing, and reviews forms used by the U.S. and Canadian governments. It also examines the status of refugees in countries not offering international protection under the 1951 Refugee Convention and/or the 1967 Protocol, such as Venezuelans in Curacao, where our intersession course will be hosted.

Taught by Elissa Mittman (UBalt Law).
